Welcome to Privilege Loyalty Program

As a privilege customer, we urge you to read the below terms and conditions carefully. In case of any queries please write to customer care or call the numbers specified below. Use of the Loyalty Program signifies your agreement to the terms and conditions set forth below.

General Terms and Conditions:

  • Membership is allowed to individuals, who are above 18 years of age at the time of joining.
  • Only one account per customer is permitted. If a customer is found to have more than one account registered in his/her name then Mumbai Duty Free has the right to close the accounts immediately.
  • Please allow up to 24hours for the points to reflect in the loyalty member’s account
  • Although a customer can redeem points immediately after accrual, we recommend that the customer waits for 24 hours before attempting redemption as the system integration might take time
  • If a customer is not active for a period of one year or more, the loyalty tier of such customer shall get downgraded to the previous level/tier, however, the points available to such customer shall remain the same.
  • All unredeemed points will expire after two years from the date of issuance of such points or transaction.
  • The passport number attached to the loyalty account should match the passport with which the customer is travelling. If the customer has obtained a new passport, the same has to be updated in the account. For doing so the customer can ask the cashier for details or write to the customer care email id (india.customerservice@mumbaidutyfree.net) with a scanned copy of the new passport (front and back).
  • Mumbai Duty Free reserves the right to refuse membership to any applicant
  • Any misuse/ fraudulent use of the account may result in termination of membership and withdrawal of all benefits.
  • Membership benefits are not transferrable and can only be availed by the individual member registered in the Privilege loyalty program.
  • Mumbai Duty Free reserves the right to terminate the account in case of inaccurate information provided by the individual
  • Mumbai Duty Free reserves the right to change the tiers and the accrual and redemption structure without any prior notice. Customer will be informed of changes in point’s structure Use of the Loyalty Program after such notice will be considered as customer's agreement to any such changes.
  • By registering to the Privilege loyalty program, the Customer agrees to storage, analysis and use of personal data of the Customer by Mumbai Duty Free as per the Mumbai Duty Free’s company policy.
  • In the case of invoice cancellation, point accrued on that transaction will also be reversed.
  • In the case of refund due to any unforeseen issue, loyalty points accrued on that transaction will be deducted from that account
  • In the case of replacement of a defective product, it will not be considered as a loyalty transaction
  • All disputes are subject to exclusive jurisdiction of Mumbai, Maharashtra.
  • Mumbai Duty Free reserves the right to terminate, withdraw or restructure the loyalty program without any prior notice and shall not be liable for any losses, injury or damages due to such termination, withdrawal or restricting.
  • A customer/member by registering to the “Privilege loyalty program” agrees and accepts all the terms and conditions stated herein.
  • A customer/member shall have no right to amend, modify or interpret the terms and conditions stated herein.
  • The decision made by Mumbai Duty Free in the event of any dispute should be binding and valid.

Accrual/award of points

1) Red tier member

  • Eligibility criteria : Spend of INR 7500
  • A customer starts accruing points after he/she is registered as a loyalty member
  • Every INR 100 loyalty customer spends on non-promotional items is equivalent to 1 point
  • Every INR 100 a loyalty customer spends on promotional items in equivalent to 1 point
  • Every100 points is equivalent to 100 INR in real value
  • The loyalty points would be awarded on the final purchase paid by the customer

2) Silver tier member

  • Eligibility criteria : Spend of INR 1,00,000 or upgrading after accumulation of 1000 points.
  • Every INR 100 a loyalty customer spends on non-promotional items is equivalent to 1.15 points.
  • Every INR 100 a loyalty customer spends on promotional items in equivalent to 1.15point.
  • Every100 points is equivalent to INR 100 in real value
  • The loyalty points would be awarded on the final purchase paid by the customer

3) Platinum tier member

  • Eligibility criteria : Spend of INR 2,00,000 or upgrading after accumulation of 2000 points.
  • Every INR 100 a loyalty customer spends on non-promotional items is equivalent to 1.25 points.
  • Every INR 100 a loyalty customer spends on promotional items is equivalent to 1.25point.
  • Every 100 points is equivalent to INR 100 in real value
  • The loyalty points would be awarded on the final purchase paid by the customer

4) Redemption

  • A loyalty customer can redeem their points once they accumulate 200 points
  • Customer should also present their valid passport to avail redemption
  • Although customers can redeem points against all products, there might be exceptions such as heavily discounted products. Please check with the cashier at the time of redemption.

Expiration of points

  • Points will expire after two years of accrual of the same. For example, if a customer accrued100 points on the13.01.2015, the same would expire on 12.01.2017.Though the point expires, a customer continues to earn points at the current level unless downgraded due to non-transaction for more than a year

Non active members

  • If a customer is not active for 1 year the tier of his/her membership will be downgraded to the previous level/tier. The customer will start earning points at the current level and will be upgraded again after he/she meets all the necessary criteria for upgrading to the next level. All the points will remain in the membership and the customer can redeem the same as per normal redemption conditions
  • It is our endeavor to ensure that our customers get their due. However, Mumbai Duty Free privilege is not responsible for any misuse

Indemnity

  • The Customer hereby agree a to indemnify, defend and hold Mumbai Duty Free, and all its officers, directors, owners, agents, employees, and its licensors (collectively, the "Indemnified Parties") harmless from and against any and all liabilities and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by Customer of the terms enumerated herein of the Agreement or the foregoing representations, warranties and covenants, including, without limitation, attorney's fees and osts.

Limitation of Mumbai Duty Free's liability and damages

  • In no event shall Mumbai Duty Free be liable for any loss arising out from lost or stolen loyalty program cards, nor for any direct, indirect, special, consequential or other damages arising out of the use of the loyalty program or the website. This includes, without limitation, lost profits, lost points, business interruption, damage to equipment, computer systems or programs, or any information system, or the loss of any information or data. The maximum liability collectively of Mumbai Duty Free shall not exceed
  • No warranty. The loyalty program, including all content, functions, materials and information made available to customer or accessed by customer through e mail communication and website,is provided on a “as is” basis. To the fullest extent permissible by law, Mumbai Duty Free makes no representation or warranties of any kind whatsoever for the content of the loyalty program, the materials, information and functions made accessible to the customer through e mail communication and website, or for the products and/or services awarded or redeemed through the program. Further, Mumbai Duty Free disclaims any express or implied warranties, including, without limitation, non-infringement, merchantability or fitness for a particular purpose. Mumbai Duty Free assumes no responsibility, and shall not be liable for any damages by use of the loyalty program or the website. Mumbai Duty Free or its subsidiaries and affiliates shall not be liable, in any manner whatsoever, for the use of the loyalty program, including, without limitation, the website and any errors contained there in. Mumbai Duty Free shall not be liable for any failure of the loyalty program, including the website, which results from acts or events beyond the company's reasonable control.

GENERAL

  • By using this website, you agree to all of below mentioned Terms and Conditions (“T&C”) and if you do not agree with all these terms and conditions, do not access or use the Website and the Pre order services.
  • Please read these T&C carefully. You are advised to regularly check for any amendments or updates to the terms and conditions from time to time. Mumbai Duty Free may add to or change or update these Terms of Use, from time to time entirely at its own discretion. You are responsible for checking these Terms of Use periodically to remain in compliance with these terms. Your use of Site and any amendment to the Terms of Use shall constitute your acceptance of these terms and you also agree to be bound by any such changes/revisions/amendments.
  • Any clause of terms and conditions if deemed invalid, void or for any reason unenforceable, shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the terms and conditions.

PERSONAL INFORMATION

  • We are dedicated to protecting the privacy and confidentiality of your personal information. We never rent or sell your details to any third party. Your data is stored securely on our database and will only be disclosed to our trusted partners for the purpose of operating pre-order Services.

ORDER AND ACCEPTANCE

  • Each order submitted constitutes an offer to purchase products. Orders are subject to Mumbai Duty Free acceptance and may be refused at Mumbai Duty Free discretion, for example in cases where:
    • All the orders are considered to be accepted post a valid confirmation code is received by the customer.
    • Orders cannot be processed due to an error in information you have provided;
    • There is an error on the web shop relating to the products that you have ordered, for example an error relating to the price or description of the product as displayed on the web shop.
    • The delivery of the product is subject to production of Confirmation code generated by Flemingo, boarding pass and the Passport of the buyer.
  • After Mumbai Duty Free receives your order, you will receive an email confirming receipt of your order. If you do not receive an email, contact Mumbai Duty Free before you try to place another order for the same product.
  • All the payments as mentioned and confirmed by Mumbai Duty Free shall be paid over the counter while receiving the product.
  • If you have any questions, comments or concerns regarding Flemingo Mumbai Duty Free’s order acceptance policy, or if you consider that your order was rejected in error, please contact Mumbai Duty Free.

ALCOHOL POLICY

  • Mumbai Duty Free allows access to liquor portal to bonafide international passengers only who are above the age of 25 years. By accessing the liquor portal of the website, the user swears and affirms that the user is bonafide international passenger and above the age of 25 years.
  • In case of misrepresentation, a legal action might be taken against the user as per the laws of the land.
  • By accessing the liquor portal of the website, the user agrees that any liquor reserved by him/her is intended for user’s personal consumption and not for resale.
  • There has been no advertisement, personal communication, solicitation, invitation or inducement of any sort whatsoever by the Mumbai Duty Free to solicit any sales of liquor through this website.
  • The user wish to gain information for his/her information and use.
  • The information is being provided to the user at user’s specific request. The information obtained or material downloaded from this portal is completely at the user’s volition.
  • The information provided under this portal is solely available at user’s request for informational purposes only, should not be interpreted as soliciting or advisement.
  • The user can obtain delivery of liquor booked by him/her from our duty free shops at Chhatrapati Shivaji International Airport, Mumbai only after verification of details submitted by user by our staff.

REFUND POLICY

Mumbai Duty Free accepts refunds subject to the following terms and conditions:

  • We will accept claims within 30days from date of purchase
  • The original / email invoice should be produced / submitted at the time of any claims
  • No Cash refund would be issued against any merchandise
  • Any Promotional offer / scheme running at the time when initial merchandise was purchased would NOT be applicable on exchange / Refund
  • We reserve right:
    • to request identification
    • to determine whether the merchandise has been damaged, abused or used.

  • The amount will be refunded /reimbursed to the same credit card through which transaction was completed.
  • Credit card refund for products which meet the refund criteria explained above will be processed within three to four working weeks or specified as per the card merchant.
  • We do not refund any perishable items, raffle tickets, pre-paid cards and high value items where there is difficulty in guaranteeing the authenticity.

WARRANTIES

  • This site is provided by Mumbai Duty Free on an “as is” basis. Mumbai Duty Free makes no representations or warranties of any kind express or implied, as to the operation of the site or the information, content, materials, or products included on this site. To the full extent permissible by applicable law, Mumbai Duty Free disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose or non-infringement. Notwithstanding that some jurisdictions may not allow the exclusions of implied warranties, but by the voluntary use of the site and voluntary access to the same, this disclaimer would continue to apply to you. Furthermore, notwithstanding the above, the access to this site and taking of any actions thereon signify that you consent and agree that irrespective of any rights that you might claim to vest in you by law, only the warranties as are expressly contained herein shall apply and that no other warranties, assurances, indemnities would apply or be enforced against us. INDEMNITY

  • You shall indemnify and hold harmless to Mumbai Duty Free and (as applicable) Flemingo’s subsidiaries, affiliates, third-parties and their respective officers, directors, agents, and employees, from any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the use of User's actions or inactions, including but not limited to any warranties, representations or undertakings or in relation to the non-fulfilment of any of its obligations under this Agreement or arising out of the User's infringement of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights.

GOVERNING LAW

  • These T&C shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Mumbai.
